Sounds of Summer! Vip Ticket Sweepstakes.

ELIGIBILITY: Open to natural persons who are legal residents of Iowa, Minnesota, North Dakota, South Dakota or Wisconsin, and who age 18 or older are or the age of majority in your state of legal residence, whichever is older, at the time of entry.  VOID IN PUERTO RICO, U.S. VIRGIN ISLANDS, AND OTHER U.S. TERRITORIES AND POSSESSIONS, AND WHEREVER PROHIBITED OR RESTRICTED BY LAW.  APFCU prize providers, and their respective parent, subsidiary and affiliate companies, employees, agents, and suppliers, and the immediate family (spouse, parents, siblings, and children) and persons living in the same household (whether related or not), are not eligible to participate.  All potential winners are subject to verification before any prize will be awarded.  Entries must be complete to be eligible.  APFCU timekeeping is the official timing of the Sweepstakes.  Only one (1) entry per email address. The Sweepstakes is subject to all applicable federal, state, municipal, territorial and local laws and regulations.  Submission of official entry or participation in these Sweepstakes constitutes full and unconditional agreement to these Official Rules.   The decisions of APFCU with regards to Entries, Eligibility and all Rules for these Sweepstakes shall be final and binding.

PRIZE:  The Grand Prize winner will receive one (1) prize, a value of approximately $400, Prize includes two (2) VIP Premium Reserved Tickets to a select concert of their choice at The Fillmore® Minneapolis between September 1, 2023 and August 31, 2024.  The Grand Prize Winner must reserve tickets at least seven (7) days prior to concert through a dedicated reservation email address. Reservations may be required (3) weeks in advance during December 2023 events. Tickets are not eligible for December 31, 2023 events, other exclusions may apply.  Tickets will be placed at will call under the winner’s name.  Winner must be present to pick up tickets; photo ID will be required.  Tickets to a particular concert are not guaranteed. Tickets are subject to availability, venue capacity, artist and age restrictions.  Selection of ticket type and/or concert seat location is solely within Live Nation’s discretion.  Parking, travel and accommodations not included and are the sole responsibility of winner and guests. Grand Prize Winner and guest must abide by all venue policies. Live Nation reserves the right to revoke tickets in its sole discretion if it or venue personnel deem Grand Prize Winner or guest(s) may be intoxicated, be a safety risk, have violated any venue policy or law, or may bring Live Nation into disrepute. There may be additional service and parking fees charged for each ticket. Not valid for private events or rentals. Some blackout dates may apply. The tickets have no cash value and cannot be exchanged for cash or credit, except as required by law. By claiming tickets, you agree to Live Nation’s Terms of Use and to abide by the health and safety measures in effect at the time of your event, which may include, but not be limited to, wearing masks, providing proof of vaccination status and/or providing proof of negative COVID-19 status. Should the event be cancelled, you will be notified as soon as reasonably possible. Use of the Tickets for unauthorized advertising, marketing or other promotional purposes is strictly prohibited. Total Approximate Retail Value is, $400, depending on the concert selected. Any difference between stated approximate retail value and actual value of prize will not be awarded.  No prize award substitutions allowed, except at APFCU’s discretion a prize of equal or greater value may be provided.  Lost or stolen prizes will not be replaced.  All expenses associated with the use and/or redemption of the Grand Prize award are the sole responsibility of winner and guest.

WINNING: One (1) Grand Prize winner will be selected from all eligible entries received by random electronic drawing conducted by APFCU on or about August 16, 2023. Winner need not be present to win.  Official notice to winner will be sent by email on or about August 16, 2023. The Grand Prize award must be claimed within ten (10) days of notification. If the winner does not claim the award within this timeframe, an alternate winner will be selected.  Winners are responsible for reporting and paying any applicable tax or tax withholdings resulting from prize award. Any valuation of the prize stated is based on available information provided to APFCU. The value of any prize awarded to a winner will be reported for tax purposes as required by law. Winner must provide APFCU with a valid taxpayer identification number or social security number before any prize will be awarded. A Form 1099 will be issued to the winner for value of prize $600 or more. 

ODDS OF WINNING: The odds of winning a prize award depend upon the total number of eligible entries received.  Prizes will be awarded provided a sufficient number of eligible entries are received and any prize awarded is validly claimed by October 16, 2023 after which no alternate winners will be selected, nor unclaimed prize awarded.

GENERAL RULES: APFCU reserves the right at its sole discretion to modify, terminate or suspend all or portion of this Sweepstakes should non-authorized human interference, fraud, printing errors, Internet viruses, hackers or other causes beyond the control of APFCU corrupt or impair administration, security, fairness or proper operation of this Sweepstakes.  APFCU assumes no responsibility for lost, late or illegible entries. APFCU is not liable for injury, loss or damage of any kind resulting from acceptance or use of a prize(s) or participation in this Sweepstakes. The name of the Grand Prize winner can be obtained after October 16, 2023 by mailing a self-addressed stamped envelope to: Affinity Plus Federal Credit Union ATTN: Marketing Department 175 W. Lafayette Frontage Rd. St. Paul, MN 55107.

By entering in these Sweepstakes, each entrant agrees to APFCU contacting entrant for the purposes of administering the Sweepstakes and distributing any prize and award. All questions or disputes regarding eligibility for these Sweepstakes, as well as the Grand Prize award, or an entrant's compliance with these Official Rules will be resolved by APFCU in its sole discretion. All potential winners are subject to verification by APFCU. APFCU will not accept screen shots or other evidence of winning in lieu of its validation process. Potential winners must continue to comply with all terms and conditions of these Official Rules. Each potential winner will be notified by mail, email or phone, as applicable. Each potential prize winner may be required to sign and return an Affidavit of Eligibility, Liability and Publicity Release ("Affidavit") and an I.R.S. Form W-9 as applicable (except where prohibited), which must be received by APFCU within seventy-two (72) hours of the time notice or attempted notice is sent, in order to claim a prize (if applicable). If a potential winner of any prize cannot be contacted, fails to sign and return the Affidavit within the required time period (if applicable), declines the prize or prize is returned as undeliverable, such potential winner forfeits the prize. In the event that a potential winner is disqualified for any reason, APFCU will select an alternate potential winner by random drawing from among all remaining eligible entries, up to three (3) alternate potential winners. All alternate potential winners are subject to all requirements set forth in these Official Rules. If an alternate winner declines the prize or is disqualified, the prize will not be awarded. 

If the Sweepstakes, or any part of it, is discontinued for any reason, APFCU, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any prize offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, or programming errors or any other reasons cause more than the stated number of prizes as set forth herein to be available and/or claimed, APFCU reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.

PUBLICITY:  Except where prohibited, participation in the Sweepstakes constitutes entrant’s consent for Sweepstakes Entities to use entrant’s name, social media identity, likeness, voice, opinions, hometown and state for promotional purposes in any media, worldwide, without further payment or consideration. 

PRIVACY:  Information submitted by entrants will be collected by APFCU’s systems based in the United States and such collection will be subject to applicable United States laws. Entrants may withdraw personal data upon request; however, entrant will be disqualified if personal data is withdrawn prior to the determination of the winner and fulfillment of the prize. Entrant’s participation in this Sweepstakes constitutes consent for APFCU to use entrant’s personal information for the purpose of administering the Sweepstakes and awarding the prizes.

LIMITATION OF LIABILITY:  APFCU is not responsible for incorrect or inaccurate transcription of information, for problems related to any of the equipment or programming associated with these Sweepstakes, for any human error, for any interruption, deletion, omission, defect, or line failure of any telephone network or electronic transmission, for problems relating to computer equipment, software, inability to access the website or online service, or for any other technical or non-technical error or malfunction. APFCU, Live Nation Worldwide, Inc. (“Live Nation”), or any related companies, parents, subsidiaries, shareholders, affiliates, partners, divisions, officers, directors, members, managers, employees and respective agents and their agencies, suppliers and other companies involved in the development or execution of the Sweepstakes, or the production or distribution of Sweepstakes materials ("Releasees") will not be liable for any printing error or irregular packaging. UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL ANY OF THE RELEASEES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THESE SWEEPSTAKES OR MERCHANDISE OFFERED, EVEN IF ANY OR ALL OF THE FOREGOING OR ANY OF THEIR AUTHORIZED REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF APFCU IMPROPERLY DENIES A WINNER ANY PRIZE, LIABILITY WILL BE LIMITED TO THE EQUIVALENT AMOUNT OF APPROXIMATE RETAIL VALUE. Sweepstakes winners agree to rely solely on the manufacturer's warranties, if any, for any prizes.  As a condition of participating, each entrant agrees that: (a) any action at law or in equity arising out of or relating to these Official Rules or the website shall be filed, and that venue properly lies, only in state or federal courts located in St. Paul, Minnesota, and entrants hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering these Sweepstakes, but in no event attorneys' fees; (c) any and all claims shall be resolved individually, without resort to any form of class action; and (d) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.  These Official Rules and the Sweepstakes shall be governed by and construed in accordance with the laws of the State of Minnesota and the laws of the United States, without giving effect to any principals of conflicts of law.  Releasees make no representation that the content on the website is appropriate or available for use in any particular location. Those who choose to access the website act on their own initiative and are responsible for compliance with all applicable laws including any applicable local laws.  These Official Rules constitute the entire agreement pertaining to the subject matter hereof and supersedes all prior or other arrangements, understandings, negotiations and discussions, whether oral or written. No waiver of any of the provisions of these Official Rules shall be deemed or shall constitute a waiver of any other provisions hereof (whether or not similar), nor shall waiver constitute a continuing waiver unless otherwise expressly provided.  If any provision of these Official Rules is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Official Rules, which will otherwise remain in full force and effect.
