California Privacy Notice

This California Privacy Notice (“Notice”) supplements the Affinity Plus Privacy Policy for individuals who reside in the State of California (“you”).

Under the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, “CCPA”), we are required to provide California Residents with information about the personal information we collect, use share and disclose when you use our website, mobile application, and our online products and services. In addition, the CCPA provides California Residents the right to make certain requests to us with respect to our data collection and sharing practices. Any terms defined in the CCPA have the same meaning when used in this Notice.

Affinity Plus may change this Notice at any time. The most recent version of this Notice, as indicated by the date at the top of this Notice, will take effect when posted unless otherwise indicated. We will provide you with additional notice if we make material changes to this Notice.

We collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household (“Personal Information”). Personal Information does not include information that is publicly available information from government records, deidentified or aggregated consumer information, and information that is specifically excluded from the scope of CCPA, such as personal information covered by the Fair Credit Reporting Act (FCRA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver’s Privacy Protection Act of 1994. Accordingly, the specific Personal Information covered by the CCPA will vary based on our relationship or interaction with you.

In the preceding 12 months, we have collected the following categories of Personal Information about California Residents:

Your California Rights

California Residents have the right to request that we disclose to you the specific pieces of Personal Information we collected about you; the categories of Personal Information that we collected about you; the categories of sources from which we collected Personal Information about you; the business or commercial purpose for collecting Personal Information about you; the specific pieces of Personal Information we collected about you; and the categories of third parties to whom we disclosed such Personal Information.

California Residents also have the right to request that we delete Personal Information that we collected from you, subject to applicable exceptions. We may deny your request to delete Personal Information if retaining the information is necessary for us or our service providers to:

  1. Complete the transaction for which we collected the Personal Information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  2. Detect and address security incidents and protect against malicious, fraudulent or illegal activity.
  3. Debug products to identify and repair errors that impair existing intended functionality.
  4. Exercise free speech, ensure the right of another consumer to exercise the consumer’s right of free speech, or exercise another right provided for by law.
  5. Comply with the California Electronic Communications Privacy Act (Cal Penal Code Section 1546 et. seq).
  6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the deletion may likely render impossible or seriously impair the achievement of such research, if you previously provided informed consent.
  7. To enable solely internal uses that are reasonably aligned with your expectation based on your relationship with us.
  8. Comply with a legal obligation.
  9. Other internal and lawful uses that are compatible with the context in which you provided the Personal Information.

California Residents have the right to request we correct Personal Information we have collected about you. You may exercise your rights as described in the “Your Choices and Rights” section in our Privacy Policy, or by emailing us at MembershipSupport@affinityplus.org,or by visiting one of our locations. California Residents also have the right to request additional details about our information practices and to not be discriminated against for exercising these rights. You may also use an authorized agent to make a request under the CCPA. If we receive your request from an authorized agent, we may ask for evidence that you have provided such agent with written authority to submit requests on your behalf. We may also require that you confirm your identity and request directly with us.

We endeavor to respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. For data portability requests, we will select a readily useable format to provide your Personal Information. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive or unfounded.

We will not discriminate against you for exercising any of your rights in this Privacy Policy and under applicable laws. Unless permitted by law, we will not deny you products or services, charge you different prices or rates for products or services, including through granting discounts or other benefits, or imposing penalties, provide you a different level or quality of goods or services, or suggest that you may receive a different price for or rate for products or services or a different level or quality of products or services.

Affinity Plus does not sell Personal Information in exchange for payment. However, the CCPA defines the term “sale” in a way that includes transfers of information relating to advertising cookies. As described in our Cookie Policy, we may share your personal data with advertising partners so that they can show ads promoting Affinity Plus. You may opt out of the use of your information for interest-based advertising purposes as described in the “Advertising and Analytics Services Provided by Others” section in our Privacy Policy or by clicking on the “Do Not Sell or Share My Personal Information” link on the homepage of our website or mobile application.
