OFFICIAL RULES: AFFINITY PLUS FEDERAL CREDIT UNION HOTTEST TICKeTS OF THE SUMMER SWEEPSTAKES

CONSUMER DISCLOSURE: NO PAYMENT OF MONEY TO THE SPONSOR IS REQUIRED TO ENTER OR WIN THE SWEEPSTAKES. A PURCHASE OR PAYMENT WILL NOT IMPROVE YOUR CHANCE OF WINNING.

SWEEPSTAKES TIMING/DESCRIPTION: The Hottest Tickets of the Summer Sweepstakes (“Sweepstakes”) entry begins at 12:00 a.m. CT June 6, 2023 and ends at 11:59 p.m. CT on June 30, 2023 (“Entry Period”).  At the end of the Entry Period, a random drawing will be conducted from among all eligible entries (see Eligibility requirements below) received during the Entry Period to select one (1) Grand Prize winner. Affinity Plus Federal Credit Union, principally located at 175 West Lafayette Frontage Road, St. Paul, MN 55107, (“APFCU”) is the sponsor of this Sweepstakes.  Facebook, Twitter, Instagram or any other social network or platform (each a “Social Account”) are not a sponsor of this Sweepstakes and do not endorse or otherwise have obligation or participation with this Sweepstakes.  The Sweepstakes will be subject to these Official Rules and by entering all participants agree to be bound by the terms and conditions herein.

ENTERING: No purchase necessary to enter or win. There are two (2) ways to enter: 

To enter through Affinity Plus Online Bank or Mobile App, an Affinity Plus Federal Credit Union member must sign into the Affinity Plus Online Banking or Mobile App to enter this sweepstakes. Once logged into their account, the member will click on the promotional banner to be taken to a secure form to register. Entries are limited to one (1) entry per day.

To enter by mail without purchase or obligation: Stop by any Affinity Plus branch to pick up a registration form. This form must include your complete name, street address, city, state, ZIP code, and daytime and evening telephone numbers (including area code) and be mail it in a business-size (#10) envelope with sufficient postage affixed, to: Hottest Tickets of the Summer Sweepstakes for Affinity Plus Federal Credit Union, 175 West Lafayette Frontage Road, St. Paul, MN 55107. Mailed entries must be postmarked between June 6 and June 30, 2023, and received by July 6, 2023, in order to be included in the random drawing. Entries are limited to one (1) per day; however, each mailed entry will count as one (1) entry into the random drawing and must be mailed in a separate, postmarked-and-stamped envelope. Entries that are mechanically reproduced, copied, illegible, incomplete, or inaccurate and entries by any means which subvert the entry process are void. Entries become the property of the Sponsor and will not be acknowledged or returned. Incomplete entries or entries not complying with these Official Rules are subject to disqualification, at the Sponsor’s sole discretion. Proof of mailing does not constitute proof of delivery. 

ELIGIBILITY: Open to Affinity Plus Federal Credit Union members, who are natural persons who, at the time of entry, are legal residents of Iowa, Minnesota, North Dakota, South Dakota or Wisconsin, and who are age 18 or older or are the age of majority in your state of legal residence.  VOID IN PUERTO RICO, U.S. VIRGIN ISLANDS, AND OTHER U.S. TERRITORIES AND POSSESSIONS, AND WHEREVER PROHIBITED OR RESTRICTED BY LAW.  APFCU prize providers, and their respective parent, subsidiary and affiliate companies, employees, agents, and suppliers, and the immediate family (spouse, parents, siblings, and children) and persons living in the same household (whether related or not), are not eligible to participate.  In the event of a dispute as to the identity of an entrant, the authorized account holder of the account will be deemed to be the entrant. All potential winners are subject to verification before any prize will be awarded.  Entries must be complete to be eligible.  APFCU timekeeping is the official timing of the Sweepstakes.  The Sweepstakes is subject to all applicable federal, state, municipal, territorial and local laws and regulations.  Submission of official entry or participation in these Sweepstakes constitutes full and unconditional agreement to these Official Rules. The decisions of APFCU with regards to Entries, Eligibility and all Rules for these Sweepstakes shall be final and binding.

PRIZE: The Grand Prize award winner will receive two (2) general admission tickets to their choice of one of three concerts: Beyoncé at Huntington Bank Stadium on July 20, 2023; Madonna at Xcel Center on July 30, 2023 or Pink at Target Field on August 10, 2023, a value of approximately $522 - $788. No prize award substitutions allowed, except at APFCU’s sole discretion a prize of equal or greater value may be provided.  All other expenses associated with the use or redemption of the Grand Prize award are the sole responsibility of winner.  Sponsor will not replace any lost or stolen tickets once they are in the winner’s possession.  Parking, travel and accommodations not included and are the sole responsibility of winner and guest.  Grand Prize Winner and guest must abide by all venue policies.   

ODDS OF WINNING: The odds of winning a prize award depend upon the total number of eligible entries received.  

WINNING: One (1) Grand Prize award winner will be drawn from all eligible entries received by random electronic drawing conducted by APFCU on or shortly after July 5, 2023. Winner need not be present to win.  Winner will be notified on or about July 7, 2023. The Grand Prize award must be claimed within three (3) days of notification. If the winner does not claim the award within this timeframe, an alternate winner will be drawn. Winners are responsible for reporting and paying any applicable tax or tax withholdings resulting from prize award. Any valuation of the prize stated is based on available information provided to APFCU. The value of any prize awarded to a winner will be reported for tax purposes as required by law. Winner must provide APFCU with a valid taxpayer identification number or social security number before any prize will be awarded. A Form 1099 will be issued to the winner for the value of prize. 

GENERAL RULES: APFCU reserves the right at its sole discretion to modify, terminate or suspend all or portion of this Sweepstakes should non-authorized human interference, fraud, printing errors, Internet viruses, hackers or other causes beyond the control of APFCU corrupt or impair administration, security, fairness or proper operation of this Sweepstakes.  APFCU assumes no responsibility for lost, late or illegible entries. APFCU is not liable for injury, loss or damage of any kind resulting from acceptance or use of a prize(s) or participation in this Sweepstakes. The name of the Grand Prize winner can be obtained after September 14, 2023 by mailing a self-addressed stamped envelope to: Affinity Plus Federal Credit Union ATTN: Marketing Department 175 W. Lafayette Frontage Rd. St. Paul, MN 55107.

By entering in these Sweepstakes, each entrant agrees to APFCU contacting entrant for the purposes of administering the Sweepstakes and distributing any prize and award. All questions or disputes regarding eligibility for these Sweepstakes, as well as the Grand Prize award, or an entrant's compliance with these Official Rules will be resolved by APFCU in its sole discretion. All potential winners are subject to verification by APFCU. APFCU will not accept screen shots or other evidence of winning in lieu of its validation process. Potential winners must continue to comply with all terms and conditions of these Official Rules. Each potential winner will be notified by mail, email or phone, as applicable. Each potential prize winner may be required to sign and return an Affidavit of Eligibility, Liability and Publicity Release ("Affidavit") and an I.R.S. Form W-9 as applicable (except where prohibited), which must be received by APFCU within seventy-two (72) hours of the time notice or attempted notice is sent, in order to claim a prize (if applicable). If a potential winner of any prize cannot be contacted, fails to sign and return the Affidavit within the required time period (if applicable), declines the prize or prize is returned as undeliverable, such potential winner forfeits the prize. In the event that a potential winner is disqualified for any reason, APFCU will select an alternate potential winner by random drawing from among all remaining eligible entries, up to three (3) alternate potential winners. All alternate potential winners are subject to all requirements set forth in these Official Rules. If an alternate winner declines the prize or is disqualified, the prize will not be awarded. 

If the Sweepstakes, or any part of it, is discontinued for any reason, APFCU, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any prize offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, or programming errors or any other reasons cause more than the stated number of prizes as set forth herein to be available and/or claimed, APFCU reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.

PUBLICITY:  Except where prohibited, participation in the Sweepstakes constitutes entrant’s consent for Sweepstakes Entities to use entrant’s name, social media identity, likeness, voice, opinions, hometown and state for promotional purposes in any media, worldwide, without further payment or consideration. 

PRIVACY:  Information submitted by entrants will be collected by APFCU’s systems based in the United States and such collection will be subject to applicable United States laws. Entrants may withdraw personal data upon request; however, entrant will be disqualified if personal data is withdrawn prior to the determination of the winner and fulfillment of the prize. Information submitted by entrants is subject to APFCU’s privacy policy: https://www.affinityplus.org/privacy-disclosures. Entrant’s participation in this Sweepstakes constitutes consent for APFCU to use entrant’s personal information for the purpose of administering the Sweepstakes and awarding the prizes.

LIMITATION OF LIABILITY:  APFCU is not responsible for incorrect or inaccurate transcription of information, for problems related to any of the equipment or programming associated with these Sweepstakes, for any human error, for any interruption, deletion, omission, defect, or line failure of any telephone network or electronic transmission, for problems relating to computer equipment, software, inability to access the website or online service, or for any other technical or non-technical error or malfunction. APFCU, LiveNation or any related companies, parents, subsidiaries, affiliates, and respective agents and their agencies, suppliers and other companies involved in the development or execution of the Sweepstakes, or the production or distribution of Sweepstakes materials ("Releasees") will not be liable for any printing error or irregular packaging,. UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL ANY OF THE RELEASEES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THESE SWEEPSTAKES OR MERCHANDISE OFFERED, EVEN IF ANY OR ALL OF THE FOREGOING OR ANY OF THEIR AUTHORIZED REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF APFCU IMPROPERLY DENIES A WINNER ANY PRIZE, LIABILITY WILL BE LIMITED TO THE EQUIVALENT AMOUNT OF APPROXIMATE RETAIL VALUE. BY PARTICIPATING IN THESE SWEEPSTAKES, AN ENTRANT WAIVES ANY AND ALL RIGHTS TO BRING ANY CLAIM OR ACTION RELATED TO SUCH MATTERS IN ANY FORUM BEYOND 1 YEAR AFTER THE FIRST OCCURRENCE OF THE KIND OF ACT, EVENT, CONDITION OR OMISSION UPON WHICH THE CLAIM OR ACTION IS BASED. TO THE FULLEST EXTENT ALLOWABLE BY LAW, THE RELEASEES SPECIFICALLY DISCLAIM ANY REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE PRODUCTS AND SERVICES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE AND IMPLIED WARRANTIES ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE. Some jurisdictions do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to all. Sweepstakes winners agree to rely solely on the manufacturer's warranties, if any, for any prizes.  As a condition of participating, each entrant agrees that: (a) any action at law or in equity arising out of or relating to these Official Rules or the website shall be resolved individually, without resort to any form of class action, and shall be filed, and that venue properly lies, only in state or federal courts located in St. Paul, Minnesota, and entrants hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering these Sweepstakes, but in no event attorneys' fees; (c) any and all claims shall be resolved individually, without resort to any form of class action; and (d) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.  These Official Rules and the Sweepstakes shall be governed by and construed in accordance with the laws of the State of Minnesota and the laws of the United States, without giving effect to any principals of conflicts of law.  Releasees make no representation that the content on the website is appropriate or available for use in any particular location. Those who choose to access the website act on their own initiative and are responsible for compliance with all applicable laws including any applicable local laws.  These Official Rules constitute the entire agreement pertaining to the subject matter hereof and supersedes all prior or other arrangements, understandings, negotiations and discussions, whether oral or written. No waiver of any of the provisions of these Official Rules shall be deemed or shall constitute a waiver of any other provisions hereof (whether or not similar), nor shall waiver constitute a continuing waiver unless otherwise expressly provided.  If any provision of these Official Rules is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Official Rules, which will otherwise remain in full force and effect.

ARBITRATION: Except where prohibited by law, as a condition of participating in this Sweepstakes, participant agrees that (i) any and all disputes and causes of action arising out of or connected with this Sweepstakes (excluding any and all disputes and causes of action brought against the APFCU arising out of or connected with the Grand Prize) shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the participant; (ii) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (iii) judgment upon such arbitration award may be entered in any court having jurisdiction. Participant agrees that any and all disputes and causes of action brought against the APFCU arising out of or connected with the grand prize shall be resolved individually, without resort to any form of class action, in the United States District Court  - District of Minnesota in and for St. Paul, MN; or, if the District Court does not have jurisdiction, then before n before any other court sitting in Ramsey County, Minnesota, having subject matter jurisdiction; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, or statutory damages, but in no event attorneys' fees. All disputes, claims and causes of action brought against APFCU arising out of or connected with such Grand Prize, and/or the use thereof shall be governed by, and construed in accordance with, the laws of the State of Minnesota, without giving effect to any choice of law or conflict of law rules (whether of the State of Minnesota or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Minnesota. Under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with participating in this Sweepstakes), and participant further waives all rights to have damages multiplied or increased.
