Official Rules: Affinity Plus Federal Credit Union Holiday Haul Ticket Sweepstakes

DESCRIPTION: Sweepstakes entry begins at 12:01 a.m. CT November 1, 2022 and ends at 11:59 p.m. CT on November 30, 2022 (“Entry Period”).  At the end of the Entry Period, a random drawing will be conducted from among all eligible entries (see Eligibility requirements below) received during the Entry Period to select one (1) Grand Prize winner.  Affinity Plus Federal Credit Union (“APFCU”) is the sponsor of this Sweepstakes.  Facebook, Twitter, Instagram or any other social network or platform (each a “Social Account”) is not a sponsor of this Sweepstakes and does not endorse or otherwise have obligation or participation with this Sweepstakes.  The Sweepstakes will be subject to these Official Rules and by entering all participants agree to be bound by the terms and conditions herein.

ENTERING: No purchase necessary to enter to win. To enter, visit https://www.affinityplus.org/landing/harmony/holiday-haul.  Upon completion, participant will receive one (1) entry into the Sweepstakes. One entry per email address is allowed.

ELIGIBILITY: Open to natural persons who are legal residents of Iowa, Minnesota, North Dakota, South Dakota or Wisconsin, and who age 18 or older are or the age of majority in your state of legal residence, whichever is older, at the time of entry.  VOID IN PUERTO RICO, U.S. VIRGIN ISLANDS, AND OTHER U.S. TERRITORIES AND POSSESSIONS, AND WHEREVER PROHIBITED OR RESTRICTED BY LAW.  APFCU prize providers, and their respective parent, subsidiary and affiliate companies, employees, agents, and suppliers, and the immediate family (spouse, parents, siblings, and children) and persons living in the same household (whether related or not), are not eligible to participate.  In the event of a dispute as to the identity of an entrant, the authorized account holder of the account will be deemed to be the entrant. All potential winners are subject to verification before any prize will be awarded.  Entries must be complete to be eligible.  APFCU timekeeping is the official timing of the Sweepstakes.  The Sweepstakes is subject to all applicable federal, state, municipal, territorial and local laws and regulations.  Submission of official entry or participation in these Sweepstakes constitutes full and unconditional agreement to these Official Rules.   The decisions of APFCU with regards to Entries, Eligibility and all Rules for these Sweepstakes shall be final and binding.

PRIZE: One (1) Grand Prize winner will receive two (2) VIP Premium reserved tickets for winner and one (1) guest to a select Live Nation® produced and promoted concert of winner’s choice at the Fillmore Minneapolis in Minneapolis, MN between January 1, 2023 and December 30, 2023.  Selection of concert seat location is solely within Live Nation’s discretion.   Parking, travel and accommodations not included and are the sole responsibility of winner and guest.  The Grand Prize Winner must reserve tickets at least seven (7) days prior to event. Reservations may be required (3) weeks in advance during December 2022 events. Tickets are not eligible for December 31, 2022 events.  Tickets will be placed at will call under the winner’s name.  Winner must be present to pick up tickets; photo ID will be required.  Tickets to a particular concert are not guaranteed. Tickets are subject to availability, venue capacity, artist and age restrictions.  Grand Prize Winner and guest must abide by all venue policies. Live Nation reserves the right to revoke Pass in its sole discretion if it or venue personnel deem Grand Prize Winner or guest may be intoxicated, be a safety risk, have violated any venue policy or law, or may bring Live Nation into disrepute. Not all events listed on www.livenation.com are Live Nation produced events. Not valid for private events or rentals. Some blackout dates may apply. The VIP tickets have no cash value and cannot be exchanged for cash or credit, except as required by law. The VIP Tickets cannot be sold or bought. Void if sold or exchanged for compensation. Use of the VIP Tickets for unauthorized advertising, marketing or other promotional purposes is strictly prohibited. Approximate Retail Value is:  $400.  No prize award substitutions allowed, except at APFCU’s discretion a prize of equal or greater value may be provided.  Lost or stolen prizes will not be replaced.  All expenses associated with the use and/or redemption of the Grand Prize award are the sole responsibility of winner.

WINNING: One (1) Grand Prize winner will be selected from all eligible entries received by random electronic drawing conducted by APFCU on or about December 1, 2022. Winner need not be present to win.  Official notice to winner will be sent by email on or about December 1, 2022. The Grand Prize must be claimed within ten (10) days of notification.  Winners are responsible for reporting and paying any applicable tax or tax withholdings resulting from prize award. Any valuation of the prize stated is based on available information provided to APFCU. The value of any prize awarded to a winner will be reported for tax purposes as required by law. Winner must provide APFCU with a valid taxpayer identification number or social security number before any prize will be awarded. A Form 1099 will be issued to the winner for value of prize $600 or more. 

ODDS OF WINNING: The odds of winning a prize award depend upon the total number of eligible entries received.  Prizes will be awarded provided a sufficient number of eligible entries are received and any prize awarded is validly claimed by December 31, 2022 after which no alternate winners will be selected, nor unclaimed prize awarded.

GENERAL RULES: APFCU reserves the right at its sole discretion to modify, terminate or suspend all or portion of this Sweepstakes should non-authorized human interference, fraud, printing errors, Internet viruses, hackers or other causes beyond the control of APFCU corrupt or impair administration, security, fairness or proper operation of this Sweepstakes.  APFCU assumes no responsibility for lost, late or illegible entries. APFCU is not liable for injury, loss or damage of any kind resulting from acceptance or use of a prize(s) or participation in this Sweepstakes. The name of the Grand Prize winner can be obtained after December 31, 2022 by mailing a self-addressed stamped envelope to: Affinity Plus Federal Credit Union ATTN: Marketing Department 175 W. Lafayette Frontage Rd. St. Paul, MN 55107.

By entering in these Sweepstakes, each entrant agrees to APFCU contacting entrant for the purposes of administering the Sweepstakes and distributing any prize and award. All questions or disputes regarding eligibility for these Sweepstakes, as well as the Grand Prize award, or an entrant's compliance with these Official Rules will be resolved by APFCU in its sole discretion. All potential winners are subject to verification by APFCU. APFCU will not accept screen shots or other evidence of winning in lieu of its validation process. Potential winners must continue to comply with all terms and conditions of these Official Rules. Each potential winner will be notified by mail, email or phone, as applicable. Each potential prize winner may be required to sign and return an Affidavit of Eligibility, Liability and Publicity Release ("Affidavit") and an I.R.S. Form W-9 as applicable (except where prohibited), which must be received by APFCU within seventy-two (72) hours of the time notice or attempted notice is sent, in order to claim a prize (if applicable). If a potential winner of any prize cannot be contacted, fails to sign and return the Affidavit within the required time period (if applicable), declines the prize or prize is returned as undeliverable, such potential winner forfeits the prize. In the event that a potential winner is disqualified for any reason, APFCU will select an alternate potential winner by random drawing from among all remaining eligible entries, up to three (3) alternate potential winners. All alternate potential winners are subject to all requirements set forth in these Official Rules. If an alternate winner declines the prize or is disqualified, the prize will not be awarded. 

If the Sweepstakes, or any part of it, is discontinued for any reason, APFCU, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any prize offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, or programming errors or any other reasons cause more than the stated number of prizes as set forth herein to be available and/or claimed, APFCU reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.

PUBLICITY:  Except where prohibited, participation in the Sweepstakes constitutes entrant’s consent for Sweepstakes Entities to use entrant’s name, social media identity, likeness, voice, opinions, hometown and state for promotional purposes in any media, worldwide, without further payment or consideration. 

PRIVACY:  Information submitted by entrants will be collected by APFCU’s systems based in the United States and such collection will be subject to applicable United States laws. Entrants may withdraw personal data upon request; however, entrant will be disqualified if personal data is withdrawn prior to the determination of the winner and fulfillment of the prize. Information submitted by entrants is subject to APFCU’s privacy policy: https://www.affinityplus.org/privacy-disclosures. Entrant’s participation in this Sweepstakes constitutes consent for APFCU to use entrant’s personal information solely for the purpose of administering the Sweepstakes and awarding the prizes, unless entrant has opted to receive e-mail communications from APFCU.

LIMITATION OF LIABILITY:  APFCU is not responsible for incorrect or inaccurate transcription of information, for problems related to any of the equipment or programming associated with these Sweepstakes, for any human error, for any interruption, deletion, omission, defect, or line failure of any telephone network or electronic transmission, for problems relating to computer equipment, software, inability to access the website or online service, or for any other technical or non-technical error or malfunction. In the event of a printing error or irregular packaging, APFCU, Live Nation Worldwide, Inc. (“Live Nation”), or any related companies, parents, subsidiaries, affiliates, and respective agents and their agencies, suppliers and other companies involved in the development or execution of the Sweepstakes, or the production or distribution of Sweepstakes materials ("Releasees") shall have any liability. UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL ANY OF THE RELEASEES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THESE SWEEPSTAKES OR MERCHANDISE OFFERED, EVEN IF ANY OR ALL OF THE FOREGOING OR ANY OF THEIR AUTHORIZED REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF APFCU IMPROPERLY DENIES A WINNER ANY PRIZE, LIABILITY WILL BE LIMITED TO THE EQUIVALENT AMOUNT OF APPROXIMATE RETAIL VALUE. BY PARTICIPATING IN THESE SWEEPSTAKES, AN ENTRANT WAIVES ANY AND ALL RIGHTS TO BRING ANY CLAIM OR ACTION RELATED TO SUCH MATTERS IN ANY FORUM BEYOND 1 YEAR AFTER THE FIRST OCCURRENCE OF THE KIND OF ACT, EVENT, CONDITION OR OMISSION UPON WHICH THE CLAIM OR ACTION IS BASED. TO THE FULLEST EXTENT ALLOWABLE BY LAW, THE RELEASEES SPECIFICALLY DISCLAIM ANY REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE PRODUCTS AND/OR SERVICES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE AND IMPLIED WARRANTIES ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE. Some jurisdictions do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to all. Sweepstakes winners agree to rely solely on the manufacturer's warranties, if any, for any prizes.  As a condition of participating, each entrant agrees that: (a) any action at law or in equity arising out of or relating to these Official Rules or the website shall be filed, and that venue properly lies, only in state or federal courts located in Minneapolis, Minnesota, and entrants hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering these Sweepstakes, but in no event attorneys' fees; (c) any and all claims shall be resolved individually, without resort to any form of class action; and (d) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.  These Official Rules and the Sweepstakes shall be governed by and construed in accordance with the laws of the State of Minnesota and the laws of the United States, without giving effect to any principals of conflicts of law.  Releasees make no representation that the content on the website is appropriate or available for use in any particular location. Those who choose to access the website act on their own initiative and are responsible for compliance with all applicable laws including any applicable local laws.  These Official Rules constitute the entire agreement pertaining to the subject matter hereof and supersedes all prior or other arrangements, understandings, negotiations and discussions, whether oral or written. No waiver of any of the provisions of these Official Rules shall be deemed or shall constitute a waiver of any other provisions hereof (whether or not similar), nor shall waiver constitute a continuing waiver unless otherwise expressly provided.  If any provision of these Official Rules is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Official Rules, which will otherwise remain in full force and effect.
